TERMS OF SERVICE

IMPORTANT NOTICE: Please read these Terms of Service carefully before using MYLO. By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use MYLO.

1. DEFINITIONS AND INTERPRETATION

In these Terms of Service, the following definitions apply:

  • MYLO / We / Us / Our – MYLO Middle East FZE, a Free Zone Establishment registered in Dubai Silicon Oasis, licensed by the Dubai Silicon Oasis Authority (DSOA).
  • Services – The MYLO mobile application, website (www.mrmylo.com), and all related features including loyalty program aggregation, balance tracking, expiration notifications, redemption assistance, and ancillary services.
  • User / You / Your – Any individual or entity that registers for, accesses, or uses the MYLO Services.
  • Account – Your registered MYLO user account and associated credentials.
  • Loyalty Programs – Third-party rewards programs (airlines, hotels, financial institutions, retail, and others) that you connect to MYLO.
  • Free Tier – The no-cost version of MYLO with limited features available to all registered users.
  • Premium Tier – The paid subscription version of MYLO offering enhanced features as described in Section 8.
  • UGC / User Content – Any content, data, reviews, ratings, tips, posts, or other material submitted by users through MYLO Services.
  • Personal Data – Information as defined under UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection.
  • GCC – Gulf Cooperation Council member states: UAE, Saudi Arabia, Qatar, Kuwait, Bahrain, and Oman.
  • DSO / DSOA – Dubai Silicon Oasis / Dubai Silicon Oasis Authority.
  • DIEZA – Dubai Integrated Economic Zones Authority, the parent authority overseeing DSO.
  • API – Application Programming Interfaces used to connect Loyalty Programs to MYLO.

In these Terms: (a) references to legislation include amendments and replacements; (b) headings are for convenience only; (c) ‘including’ means ‘including without limitation’; (d) singular includes plural and vice versa; (e) these Terms are binding on your heirs, successors, and permitted assigns.

2. ACCEPTANCE OF TERMS

2.1 Binding Agreement

By accessing or using MYLO in any manner, including creating an Account, downloading the application, browsing our website, or using any feature of the Services, you enter into a legally binding agreement with MYLO Middle East FZE governed by these Terms of Service. Your continued use of the Services constitutes ongoing acceptance of these Terms as updated from time to time.

2.2 Methods of Acceptance

Acceptance is effected by any of the following actions:

  • Clicking ‘I Agree’, ‘Accept’, ‘Sign Up’, or similar affirmative action during onboarding
  • Creating or logging into an Account
  • Accessing or using any feature of the Services after these Terms are displayed
  • Downloading or installing the MYLO mobile application
  • Connecting any Loyalty Program to MYLO

2.3 Authority to Accept

By accepting these Terms, you represent and warrant that: (a) you have the legal capacity to enter into binding contracts under applicable law; (b) if accepting on behalf of a legal entity, you have authority to bind that entity; (c) your use of MYLO does not violate any applicable law, regulation, or third-party obligation.

2.4 Electronic Acceptance

In accordance with UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services, your electronic acceptance of these Terms constitutes a valid, binding contract equivalent to a handwritten signature. Electronic records of your acceptance will be maintained by MYLO.

3. USER ELIGIBILITY AND AGE RESTRICTIONS

3.1 Minimum Age Requirement

MYLO Services are available to users aged 13 years and older. By using MYLO, you represent and warrant that you meet the applicable minimum age requirement in your jurisdiction.

AGE RESTRICTION NOTICE: If you are under 18 years of age, you must obtain verifiable consent from a parent or legal guardian before using MYLO. MYLO reserves the right to verify age and parental consent at any time.

3.2 Minors (Ages 13-17)

Users between the ages of 13 and 17 (“Minors”) may use MYLO subject to the following conditions:

  • A parent or legal guardian must review and consent to these Terms on the Minor’s behalf
  • The parent or guardian accepts full responsibility for the Minor’s use of MYLO
  • MYLO may require documented proof of parental consent at any time
  • Certain features of MYLO may be restricted or unavailable to Minors
  • Minors may be subject to additional limitations on data collection and processing
  • The parent or guardian may contact privacy@mrmylo.com to manage or delete their child’s data

IMPORTANT NOTICE FOR LOYALTY PROGRAM CONNECTIONS: Most third-party Loyalty Programs (including airlines, hotels, and financial institutions) independently require users to be 18 years of age or older. MYLO does not verify compliance with third-party program age requirements. Minors who connect Loyalty Programs do so at their own risk and subject to each program’s terms. MYLO assumes no liability for a Minor’s use of or connection to any third-party Loyalty Program.

3.3 Children Under 13

MYLO does not knowingly collect, process, or retain Personal Data from children under the age of 13. If we discover that a user under 13 has registered for MYLO without appropriate parental consent, we will immediately:

  • Suspend the Account pending investigation
  • Delete all Personal Data associated with the Account
  • Notify the parent or guardian if contact information is available

If you believe a child under 13 has created a MYLO Account, please contact privacy@mrmylo.com immediately.

3.4 Geographic Eligibility

MYLO Services are currently available to users located in the GCC region and may be expanded to other territories at MYLO’s discretion. MYLO makes no representation that the Services are appropriate or available in all jurisdictions. Users accessing MYLO from outside supported territories do so at their own initiative and risk.

3.5 B2B Eligibility

Business users and enterprises accessing MYLO through a business account or API arrangement must: (a) be duly registered legal entities; (b) have an authorised representative with authority to bind the entity; (c) comply with applicable corporate laws in their jurisdiction; (d) execute any applicable business agreement or Data Processing Addendum required by MYLO.

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation

To access the full features of MYLO, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to keep this information updated at all times. MYLO reserves the right to reject any registration or cancel any Account at its sole discretion.

4.2 Account Accuracy

You represent and warrant that all information provided during registration and throughout your use of MYLO is truthful, accurate, and complete. Providing false, misleading, or impersonating information is a material breach of these Terms and grounds for immediate Account suspension or termination.

4.3 Account Security Obligations

You are solely responsible for:

  • Maintaining the confidentiality of your Account credentials (username, password, and any authentication codes)
  • All activities that occur under your Account, whether or not authorised by you
  • Immediately notifying MYLO at support@mrmylo.com of any suspected unauthorised access or security breach
  • Ensuring you log out of your Account after each session, especially on shared devices
  • Not sharing your Account credentials with any third party

4.4 Account Liability

MYLO shall not be liable for any loss, damage, or harm resulting from your failure to maintain Account security or from unauthorised access to your Account due to your negligence. You accept full responsibility for any activities conducted through your Account.

4.5 One Account Per User

You may register only one personal Account on MYLO. Creating multiple accounts to circumvent restrictions, accumulate benefits, or for any other purpose is prohibited and constitutes a breach of these Terms. Business accounts are subject to separate arrangements.

4.6 Loyalty Program Connections

When connecting third-party Loyalty Programs to MYLO, you represent that you: (a) are the authorised account holder of each connected Loyalty Program; (b) are permitted under each program’s terms to connect to third-party aggregation services; (c) grant MYLO read-only API access solely for aggregation purposes; (d) understand that MYLO does not store raw passwords but uses secure OAuth tokens or equivalent authentication methods.

5. ACCEPTABLE USE POLICY

5.1 Permitted Use

MYLO grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services strictly for: (a) personal, non-commercial loyalty program management; (b) authorised business purposes under an applicable B2B agreement; (c) any other purpose expressly permitted by MYLO in writing.

5.2 Prohibited Activities

You must not, and must not attempt to, do any of the following:

  • Violate any applicable law, regulation, court order, or regulatory requirement, including UAE laws, Dubai Laws, DSO regulations, and GCC regional laws
  • Use MYLO for any unlawful purpose, including money laundering, terrorist financing, fraud, or market manipulation
  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of any MYLO software
  • Circumvent, disable, or interfere with any security, access control, or authentication mechanism of MYLO
  • Scrape, crawl, or use any automated tools, bots, or scripts to access or extract data from MYLO without written authorisation
  • Transmit viruses, malware, spyware, ransomware, or any other malicious code through the Services
  • Conduct denial-of-service (DoS), distributed denial-of-service (DDoS) attacks, or any other disruptive interference with MYLO’s infrastructure
  • Access another user’s Account, impersonate any person or entity, or misrepresent your affiliation
  • Harvest, collect, or compile other users’ Personal Data without their consent
  • Post or transmit any content that is unlawful, defamatory, harassing, abusive, obscene, pornographic, or otherwise offensive
  • Post content that promotes or glorifies violence, discrimination, or hatred on the basis of race, ethnicity, religion, gender, sexual orientation, nationality, or disability
  • Use MYLO to spam, phish, or send unsolicited commercial communications
  • Resell, sublicence, or commercially exploit the Services or any MYLO data without written authorisation
  • Use MYLO in any manner that violates the terms of any connected Loyalty Program
  • Create or distribute content that infringes any third party’s intellectual property rights
  • Engage in any conduct that damages MYLO’s reputation, business relationships, or goodwill

5.3 Compliance with Loyalty Program Terms

Your use of MYLO must at all times comply with the terms and conditions of each Loyalty Program you connect. MYLO is not responsible for consequences arising from violations of third-party Loyalty Program terms.

5.4 Monitoring and Enforcement

MYLO reserves the right (but not the obligation) to monitor use of the Services for compliance with these Terms. Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Account, removal of content, and/or referral to appropriate law enforcement or regulatory authorities.

6. USER-GENERATED CONTENT

6.1 Types of User Content

MYLO may permit users to submit, post, or share various forms of User Content, including reviews and ratings of Loyalty Programs, tips and redemption advice for the community, posts in community forums or discussion boards, and other content types as MYLO may introduce from time to time.

6.2 Ownership of User Content

You retain all ownership rights in the original content you create and submit to MYLO. You are solely responsible for your User Content and the consequences of posting it. MYLO does not claim ownership of your User Content.

6.3 Licence Grant to MYLO

By submitting User Content to MYLO, you grant MYLO a worldwide, royalty-free, non-exclusive, sublicensable, perpetual licence to: (a) host, store, display, reproduce, and distribute your User Content within the Services; (b) modify, translate, and create derivative works for formatting, display, or technical purposes; (c) use your User Content to improve MYLO’s Services, algorithms, and features (in anonymised or aggregated form); (d) sublicence these rights to MYLO’s service providers to the extent necessary to operate the Services.

This licence continues even if you delete your User Content from the Services, to the extent it has been shared with other users or incorporated into aggregated data.

6.4 Content Standards

All User Content must comply with the following standards:

  • Be truthful, accurate, and not misleading
  • Not infringe any third-party intellectual property, privacy, or personality rights
  • Not contain defamatory, harassing, abusive, threatening, or hateful material
  • Not contain adult content, graphic violence, or material inappropriate for a 13+ audience
  • Not constitute spam, advertising, or unsolicited promotion
  • Not violate any applicable law or regulation, including UAE Cybercrime Law No. 5 of 2012
  • Not disclose confidential information of any third party

6.5 Content Moderation

MYLO reserves the right (but not the obligation) to review, moderate, edit, reject, or remove any User Content that, in MYLO’s sole determination, violates these Terms, applicable law, or MYLO’s content guidelines. MYLO is not liable for any User Content posted by users, and moderation decisions are final.

6.6 Content Representations

By submitting User Content, you represent and warrant that: (a) you own or have the necessary rights to submit and licence the content; (b) the content does not violate any third-party rights; (c) the content complies with all applicable laws; (d) any factual claims in the content are accurate to the best of your knowledge.

6.7 Reporting Objectionable Content

Users may report content that violates these Terms by contacting support@mrmylo.com or using in-app reporting tools. MYLO will review reports and take appropriate action at its discretion.

7. INTELLECTUAL PROPERTY RIGHTS

7.1 MYLO’s Intellectual Property

All intellectual property rights in and to the MYLO Services, including the application, website, software, design, graphics, logos, trademarks, trade names, service marks, data, databases, algorithms, features, and all content created by MYLO (“MYLO IP”), are owned by or licensed to MYLO Middle East FZE and are protected under UAE Federal Law No. 37 of 1992 on Trademarks, UAE Federal Law No. 7 of 2002 on Copyrights and Neighbouring Rights, and applicable international intellectual property conventions.

7.2 Restrictions on MYLO IP

You may not, without MYLO’s prior written consent:

  • Copy, reproduce, republish, upload, or distribute any MYLO IP
  • Modify, adapt, translate, or create derivative works based on MYLO IP
  • Use any MYLO trademarks, logos, or brand elements for any commercial purpose
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Frame or mirror any MYLO content without written permission

7.3 Limited Licence to User

Subject to your compliance with these Terms, MYLO grants you a limited, personal, non-exclusive, non-transferable, revocable licence to: (a) access and use the Services for your personal and authorised business purposes; (b) download and use the MYLO mobile application on your personal device(s). This licence does not include any rights to sub-licence, sell, resell, or commercially exploit the Services.

7.4 Feedback and Suggestions

If you provide MYLO with feedback, suggestions, ideas, or recommendations regarding the Services (“Feedback”), you assign all intellectual property rights in such Feedback to MYLO, and MYLO may use Feedback without restriction or compensation to you. MYLO is under no obligation to implement any Feedback.

7.5 Third-Party Intellectual Property

MYLO respects third-party intellectual property rights. If you believe any content on MYLO infringes your intellectual property rights, please notify legal@mrmylo.com with: (a) identification of the work claimed to be infringed; (b) identification of the infringing material and its location on MYLO; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorised; (e) a statement under penalty of perjury that the information is accurate and you are the rights holder or authorised to act on their behalf.

8. PAYMENT TERMS, SUBSCRIPTIONS AND REFUNDS

8.1 Free Tier

MYLO offers a Free Tier at no charge, subject to usage limitations as set out in MYLO’s feature comparison documentation published on www.mrmylo.com and updated from time to time.

8.2 Premium Tier — Subscription

MYLO’s Premium Tier is available on a recurring subscription basis (monthly or annual). By subscribing, you authorise MYLO or its payment processor to charge your nominated payment method automatically at the start of each billing period until you cancel.

8.3 Pricing

Current subscription pricing is displayed at www.mrmylo.com/pricing and within the MYLO application. All prices are displayed in UAE Dirhams (AED) unless otherwise specified. MYLO reserves the right to modify pricing at any time with 30 days’ prior notice to existing subscribers.

8.4 Auto-Renewal

IMPORTANT: Your Premium subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. You will be charged at the start of each new billing period. Manage or cancel your subscription in Account Settings or through your App Store/Google Play account.

In accordance with UAE Federal Law No. 15 of 2020 on Consumer Protection, MYLO will provide clear notice of auto-renewal terms at the time of purchase and in renewal reminders sent at least 7 days before each renewal date.

8.5 Cooling-Off Period

In accordance with UAE Consumer Protection Law, you have a 14-day cooling-off period from the date of your initial subscription purchase during which you may cancel and receive a full refund, provided you have not materially used the Premium features. To exercise this right, contact support@mrmylo.com within 14 days of purchase.

8.6 Refunds

Except as provided in Section 8.5 (cooling-off period), all subscription fees are non-refundable once a billing period has commenced. MYLO may, at its sole discretion, issue partial refunds or service credits in exceptional circumstances. Refund requests should be directed to support@mrmylo.com.

8.7 Payment Processing

Payments are processed by our third-party payment processor(s). MYLO does not store full payment card data. All payment transactions are subject to the payment processor’s terms and conditions. In the event of a failed payment, MYLO will attempt to notify you and may suspend Premium access until payment is resolved.

8.8 In-App Purchases

If you subscribe through Apple App Store or Google Play Store, the applicable App Store’s payment terms govern the transaction. MYLO has no control over the App Store’s billing, refund, or cancellation processes, and users should refer to the relevant App Store’s policies for those matters.

8.9 Taxes

Subscription prices displayed may exclude Value Added Tax (VAT) where applicable under UAE Federal Tax Authority regulations. Where VAT applies, it will be added to the displayed price and clearly shown at checkout. You are responsible for any taxes applicable in your jurisdiction.

8.10 B2B Billing

Business accounts and API access arrangements are subject to separate pricing agreements. Payment terms, invoicing, and credit arrangements for B2B users are governed by the applicable business agreement executed between the parties.

9. DISCLAIMERS AND SERVICE WARRANTIES

THE FOLLOWING DISCLAIMERS ARE IMPORTANT. PLEASE READ CAREFULLY.

9.1 ‘As-Is’ Provision of Services

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYLO PROVIDES THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MYLO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Services will meet your requirements or expectations
  • Warranties that the Services will be uninterrupted, timely, secure, or error-free
  • Warranties as to the accuracy, completeness, or reliability of any information obtained through the Services

9.2 Loyalty Program Data Accuracy

MYLO aggregates data from third-party Loyalty Programs via API connections. MYLO does not guarantee the accuracy, completeness, timeliness, or reliability of Loyalty Program data displayed in the Services. Loyalty program balances, expiry dates, and redemption values are sourced from and subject to each third-party program and may not reflect real-time data. Always verify critical Loyalty Program information directly with the program provider.

9.3 Third-Party Services

MYLO is not responsible for the availability, accuracy, terms, policies, or actions of any third-party Loyalty Programs, payment processors, analytics providers, or other third parties whose services are accessed through or in connection with MYLO. Your use of third-party services is at your own risk and subject to each third party’s terms.

9.4 Service Availability

MYLO does not guarantee uninterrupted access to the Services. The Services may be temporarily unavailable due to maintenance, upgrades, technical failures, cyber-attacks, force majeure events, or events outside MYLO’s reasonable control. MYLO will endeavour to provide advance notice of planned maintenance where possible.

9.5 No Financial Advice

Nothing in the Services constitutes financial, investment, tax, or legal advice. Loyalty program valuations, redemption recommendations, and point calculations are for informational purposes only and should not be relied upon as professional advice. MYLO is not licensed as a financial advisor or investment manager.

9.6 GCC Regional Variations

Loyalty Program features, availability, and redemption options may vary by jurisdiction. MYLO makes no warranty that all features are available or compliant in every GCC territory. Users in Saudi Arabia, Qatar, Kuwait, Bahrain, and Oman should independently verify compliance with local regulations.

10. LIMITATION OF LIABILITY

THIS SECTION LIMITS MYLO’S FINANCIAL LIABILITY TO YOU. IT IS AN IMPORTANT PART OF THE AGREEMENT BETWEEN US.

10.1 Exclusion of Consequential Loss

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW AND APPLICABLE GCC REGULATIONS, MYLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: (a) loss of profits or revenue; (b) loss of loyalty points, miles, or rewards; (c) loss of data or information; (d) business interruption; (e) loss of goodwill; (f) any other intangible loss, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF MYLO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Cap on Direct Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLO’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (a) THE TOTAL AMOUNT PAID BY YOU TO MYLO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (b) AED 500 (FIVE HUNDRED UAE DIRHAMS), WHICHEVER IS GREATER.

10.3 Essential Basis of Bargain

You acknowledge that the limitations of liability in this Section reflect a fair allocation of risk and are an essential element of the basis of the bargain between MYLO and you. MYLO would not have entered into these Terms without such limitations.

10.4 Statutory Rights Preserved

Nothing in this Section limits MYLO’s liability for: (a) death or personal injury caused by MYLO’s gross negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under UAE Federal Law No. 15 of 2020 on Consumer Protection or other mandatory applicable law.

10.5 Force Majeure

MYLO is not liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, acts of God, war, terrorism, pandemic, governmental actions, cyberattacks, power outages, telecommunications failures, or failure of third-party service providers.

11. INDEMNIFICATION

11.1 User Indemnification Obligation

To the maximum extent permitted by UAE law, you agree to indemnify, defend, and hold harmless MYLO Middle East FZE and its officers, directors, employees, contractors, agents, licensors, and successors (“MYLO Parties”) from and against any and all claims, demands, actions, losses, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or in connection with:

  • Your use of or access to the Services
  • Your violation of any provision of these Terms
  • Your violation of any applicable law, regulation, or third-party rights
  • Any User Content you submit, post, or transmit through MYLO
  • Your connection of Loyalty Programs in breach of third-party terms
  • Any dispute between you and a third party related to your use of MYLO
  • Your infringement of any intellectual property or other rights of any person or entity

11.2 MYLO’s Right to Control Defence

MYLO reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify MYLO, and you agree to cooperate with MYLO’s defence of such claims. You will not settle any claim without MYLO’s prior written consent.

12. ACCOUNT SUSPENSION AND TERMINATION

12.1 Termination by User

You may terminate your Account at any time by: (a) using the Account deletion feature within the MYLO application (Account Settings > Delete Account); (b) submitting a written termination request to support@mrmylo.com. Termination will be processed within 30 days. Deletion of your Account is subject to the data retention provisions of our Privacy Policy.

12.2 Termination by MYLO — For Cause

MYLO may immediately suspend or terminate your Account without prior notice if you:

  • Breach any provision of these Terms
  • Violate any applicable law or regulatory requirement
  • Engage in fraudulent, deceptive, or abusive conduct
  • Fail to pay applicable subscription fees
  • Create risk of legal or regulatory exposure for MYLO
  • Misuse the Services or harm other users
  • Provide false or misleading information during registration or use

12.3 Termination by MYLO — For Convenience

MYLO may also terminate or suspend your Account or the Services with 30 days’ written notice for any reason, including business decisions, regulatory requirements, or discontinuation of the Services.

12.4 Effect of Termination

Upon termination: (a) your licence to use the Services immediately ceases; (b) MYLO may delete your Account data subject to legal retention obligations; (c) provisions of these Terms that by their nature should survive termination (including Sections 7, 10, 11, 13, 14, 15, and 16) shall continue in full force.

12.5 Account Deletion Process

To delete your Account: navigate to Account Settings > Privacy > Delete My Account in the MYLO application, or submit a request to support@mrmylo.com. Upon verification of your identity, Account deletion will be completed within 30 days, with Personal Data erased or anonymised in accordance with our Privacy Policy, subject to any legal retention obligations.

13. PRIVACY AND DATA PROTECTION

Your privacy is of paramount importance to MYLO. Our collection, use, and protection of your Personal Data is governed by our Privacy Policy, which is incorporated into these Terms by reference and available at www.mrmylo.com/privacy. By using MYLO, you acknowledge and consent to data processing as described in the Privacy Policy.

MYLO processes Personal Data in compliance with UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection, applicable DSOA data regulations, and where relevant, the Saudi Personal Data Protection Law and other GCC data protection frameworks.

14. MODIFICATION OF TERMS

14.1 Right to Modify

MYLO reserves the right to modify, update, or replace these Terms at any time. Changes may be required to reflect: (a) changes in applicable UAE, Dubai, DSO, or GCC laws and regulations; (b) new features or services; (c) business decisions; (d) improvements to legal clarity or user experience.

14.2 Notice of Changes

MYLO will provide notice of material changes to these Terms by:

  • Sending an email notification to your registered email address
  • Displaying a prominent notice within the MYLO application
  • Updating the ‘Last Updated’ date at the top of these Terms

Non-material changes (such as formatting, typographical corrections, or clarifications that do not affect your rights) may be made without notice.

14.3 Effective Date of Changes

Material changes to these Terms will take effect 30 days after notice is provided, except where a shorter period is required by applicable law. Your continued use of MYLO after the effective date constitutes acceptance of the revised Terms.

14.4 Right to Reject Changes

If you do not agree to revised Terms, you must cease using MYLO and delete your Account before the effective date of the changes. Your continued use of the Services after the effective date constitutes your binding acceptance of the modified Terms.

15. CLASS ACTION WAIVER

IMPORTANT: BY USING MYLO, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION PROCEEDINGS AGAINST MYLO.

To the maximum extent permitted by UAE law: (a) all disputes must be resolved on an individual basis; (b) you may not bring or participate in any class action, collective action, consolidated action, or representative proceeding against MYLO; (c) you may not consolidate your claims with those of any other user without MYLO’s prior written consent; (d) the arbitral tribunal or court shall have no authority to conduct class-wide proceedings or award class-wide relief.

If a court or arbitral tribunal of competent jurisdiction finds this waiver unenforceable with respect to a particular claim, that claim must be severed and litigated separately, while the remaining claims proceed individually as provided above.

Nothing in this Section prevents you from bringing individual claims before the Dubai Consumer Rights Department or other regulatory authorities in the exercise of mandatory consumer protection rights.

16. DISPUTE RESOLUTION AND GOVERNING LAW

16.1 Governing Law

These Terms and your use of MYLO Services are governed by and construed in accordance with the laws of the Emirate of Dubai and the United Arab Emirates, specifically including Dubai Law No. 16 of 2005 Concerning Dubai Silicon Oasis, regulations issued by the Dubai Silicon Oasis Authority (DSOA), Dubai Integrated Economic Zones Authority (DIEZA) regulations, and applicable UAE Federal laws. MYLO operates under UAE civil law as applied in Dubai, and these Terms are expressly not subject to the laws of the Dubai International Financial Centre (DIFC) or Abu Dhabi Global Market (ADGM).

16.2 Mandatory Good-Faith Resolution — First Step

Before initiating any formal legal proceedings, you agree to: (a) contact MYLO at legal@mrmylo.com with a detailed written description of your dispute; (b) allow MYLO 60 days to investigate and respond in good faith; (c) participate in mediation if reasonably requested by MYLO. Failure to complete this step may result in dismissal of any subsequently filed claim.

16.3 DSOA Mediation (Disputes up to AED 100,000)

For disputes not exceeding AED 100,000, the parties may first attempt mediation through the Dubai Silicon Oasis Authority’s administrative dispute resolution mechanisms, where available. Mediation must be completed within 60 days of initiation; if unsuccessful, the parties may proceed to arbitration or litigation as below.

16.4 Arbitration — Dubai International Arbitration Centre (DIAC)

Subject to the mandatory first step above, disputes may be resolved by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its current Arbitration Rules, with the following parameters:

  • Seat of Arbitration: Dubai, United Arab Emirates
  • Language: English and/or Arabic (as agreed between the parties)
  • Number of Arbitrators: One (1) for disputes under AED 500,000; Three (3) for disputes of AED 500,000 or above
  • Costs: Shared equally between the parties unless the tribunal determines otherwise
  • Award: Final, binding, and enforceable under UAE Federal Law No. 6 of 2018 on Arbitration

16.5 Dubai Courts — Exclusive Jurisdiction

Where arbitration is not elected or is inapplicable, the parties submit to the exclusive jurisdiction of the Dubai Courts of First Instance, Dubai Courts of Appeal, and Dubai Court of Cassation. MYLO’s registered address in Dubai Silicon Oasis establishes Dubai as the appropriate forum.

16.6 Sharia-Compliant Dispute Resolution (Optional)

Users who prefer Islamic dispute resolution may request referral to the Dubai Islamic Economy Development Centre or another mutually agreed Sharia-compliant arbitration body by submitting a written request to legal@mrmylo.com within 30 days of the dispute arising.

16.7 Limitation Period

All claims against MYLO must be filed within 12 months from the date the cause of action arose. Claims not filed within this period are permanently time-barred, to the extent permitted by UAE law.

16.8 KSA Users — Compliance Note

FLAG — SAUDI ARABIA USERS: Users accessing MYLO from the Kingdom of Saudi Arabia may have additional rights under Saudi Consumer Protection regulations and the Saudi Personal Data Protection Law (PDPL). The PDPL has extraterritorial reach and grants KSA residents specific data rights. MYLO complies with PDPL requirements applicable to its services. KSA users may also have the right to escalate complaints to the Saudi Communications and Information Technology Commission (CITC) or the Saudi Data and Artificial Intelligence Authority (SDAIA). 16.9 Statutory Rights Preserved

Nothing in this Section limits any mandatory consumer protection rights or data subject rights you hold under applicable UAE law, Saudi law, or other mandatory GCC law that cannot be waived by agreement.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable B2B or business agreements, constitute the entire agreement between you and MYLO regarding the Services and supersede all prior agreements, representations, and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.

17.3 Waiver

MYLO’s failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. No waiver shall be effective unless in writing signed by an authorised representative of MYLO.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without MYLO’s prior written consent. MYLO may assign its rights and obligations under these Terms to an affiliate, successor, or acquirer without notice or consent.

17.5 Language

These Terms are drafted in English. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail. Arabic translations may be provided for convenience where required by UAE regulations.

17.6 Notices

All notices to MYLO under these Terms must be sent in writing to legal@mrmylo.com. MYLO will send notices to the email address registered to your Account. Notices are deemed received: (a) immediately if sent by email (absent bounce/delivery failure notification); (b) on the next business day if sent by courier or registered post.

17.7 Relationship of Parties

Nothing in these Terms creates any employment, agency, partnership, joint venture, or fiduciary relationship between you and MYLO. You and MYLO are independent parties.

17.8 Third-Party Rights

These Terms do not confer any rights or remedies on any third party unless expressly stated. Third parties have no right to enforce any provision of these Terms.
